Experience

Kevin is a partner with the firm’s Litigation practice.  He helps companies and their owners win their most important legal battles involving real estate, intellectual property, and business relationships.  He protects valuable company assets and revenue streams from attack, and enforces important company and stakeholder rights.

Kevin’s courtroom experience sets him apart.  He won his first trial the first day he was sworn in as an attorney, won his first appeal in his second year of practice, and has served as lead counsel in trials, appeals, and arbitrations ever since.  That experience allows Kevin to quickly "diagnose" a dispute and find the opponent's most vulnerable pressure points to leverage a fast, favorable settlement.  When settlement cannot be achieved he takes pride in courtroom success.  He also recognizes that his clients' business objectives drive litigation strategy, and that courtroom efforts must harmonize with the greater business good.

Kevin’s practice focuses primarily on middle-market companies and their stakeholders (owners, partners, members/managers, and private equity firms) in litigation based in California and elsewhere concerning:

  • Real Estate Disputes: Litigation involving secured transactions, deeds of trust, foreclosure and anti-deficiency, receivership, development agreements, joint ventures, and commercial leases
  • I.P. Disputes: Litigation involving trade secrets, trademarks, and patents
  • General Business Disputes: Litigation involving contracts, fraud, fiduciary duties, interference and unfair competition, entity ownership and management rights, dissolution, lender/borrower/guarantor liability, and Uniform Commercial Code sales/leases
  • Appeals and Writs: Civil appeals and writs to the California Courts of Appeal and United States Court of Appeals for the Federal District.

Kevin’s recent courtroom experience includes:

  • Lead trial attorney in a two-week jury trial prosecuting a Uniform Commercial Code promissory note case; obtained judgment and “prevailing party” attorney fee awards totaling $2.6 Million.
  • Lead attorney in a jury trial defending a former apartment building owner in an action alleging fraud and condominium conversion-based claims. Defeated several of plaintiff's claims by summary judgment. Remaining claims settled after jury selection and pre-trial motions for about 2% of the plaintiff's initial demand.
  • Lead trial attorney in court trial defending claims of breach of fiduciary duty and declaratory relief regarding managerial authority over an LLC.  Plaintiff agreed to dismiss his declaratory relief claim with prejudice during the third day of trial.  Combined with pre-trial summary adjudication of the breach of fiduciary duty claim, Kevin’s client obtained complete victory.
  • Lead attorney in several cases involving temporary restraining orders and preliminary injunctions based on claims of trade secret theft, “corporate raiding” and solicitation, unfair competition, and trademark infringement.
  • Lead appellate attorney in several appeals, including two published victories in real estate disputes and an amicus curiae brief filed in the United States Court of Appeals for the Federal Circuit on behalf of Wi-Fi manufacturers, joined by Microsoft Corporation, in a globally watched patent infringement case.
